(a) In addition to the civil sanctions provided for herein, whoever violates any section or provision of this chapter shall be guilty of a misdemeanor punishable as follows:
(1) On a first offense, as a minor misdemeanor;
(2) On a second offense, as a fourth degree misdemeanor; and
(3) On a third or subsequent offense, as a first degree misdemeanor.
(b) Each day's violation shall constitute a separate offense.
