Any person, firm or corporation violating or failing to comply with any of the provisions of this ordinance shall be guilty of a minor misdemeanor and when convicted shall be fined for the first offense not more than one hundred dollars ($100.00) and costs; a second offense within one year shall be deemed to be a misdemeanor of the fourth degree, punishable by a fine not to exceed two hundred fifty dollars ($250.00) and a jail sentence not to exceed 30 days, and costs. In addition, the person shall replace the tree with a size and species recommended by the Tree Commission. Each tree affected by a violation of this ordinance shall constitute a separate offense.
