1030.25 APPEALS.
   (a)   Appeals to the Planning and Zoning Commission concerning the interpretation or administration of this chapter may be taken by any owner of the property with a substantial interest in the matter who is adversely affected, or by a governmental officer, department, commission or bureau. Such appeal shall be taken within 20 days after the date of the decision, by filing with the City Engineer's office or with the Planning and Zoning Commission a notice of appeal specifying the decision of the Tree Commission from which the appeal is being made.
   (b)   The Planning and Zoning Commission shall hold a public hearing for consideration of an appeal from a decision of the Tree Commission unless a resolution is passed, by affirmative vote, declaring that a hearing is not needed in the specific case being considered. Notice of public hearings shall be conducted in the manner described as outlined in Section 6.06 of the City of Greenville Zoning and Subdivision Regulations.
   (c)   An application for appeal shall contain all of the information as outlined for an “Application for Variance and Appeals” as outlined under Section 6.03 of the City of Greenville Zoning and Subdivision Regulations. Within 60 days after the regular meeting of the Planning and Zoning Commission following submittal of an appeal filed pursuant to Section 6.03 of the City of Greenville Zoning and Subdivision Regulations, the Commission shall either approve, approve with supplementary conditions as specified in April 12, 2006Section 6.04 of the City of Greenville Zoning and Subdivision Regulations, or disapprove the request for appeal. If the appeal is approved, or approved with supplementary conditions, the Commission shall make a finding that the reasons set forth in the appeal justify the granting of the appeal. The Commission shall transmit a written copy of its decision and findings to the Tree Commission. After action is taken by the Planning Commission, the applicant, or other party adversely affected by the action, may seek relief through an appeal to the City Council. Such an appeal must be filed within 30 days from the date of the action by the Commission. A copy of the notice of appeal shall be served on the Secretary of the Planning and Zoning Commission by the aggrieved party within seven days from the date of the filing of the appeal.
