Whoever violates Section 1042.07 is guilty of violating a water use restriction, a minor misdemeanor for a first offense and shall be fined not more than one hundred dollars ($100.00); on a second offense such person is guilty of a misdemeanor of the fourth degree and shall be fined not more than two hundred fifty dollars ($250.00) or imprisoned not more than thirty days, or both; on a third or subsequent offense such person is guilty of a misdemeanor of the third degree and shall be fined not more than five hundred dollars ($500.00) or imprisoned not more than sixty days, or both. A separate offense shall be deemed committed each day during or on which a violation occurs or continues and the offender shall be subject to the enhanced penalties set forth herein. Upon a third offense, such violation shall result in the immediate shut-off of water service to the premises occupied by such offender.
