§ 155.134 RELEASE OR REDUCTION OF PERFORMANCE BOND.
   (A)   The Commission shall not accept required public improvements nor release or reduce a performance bond until the Town Council has submitted a certificate stating that all required improvements have been satisfactorily completed and the subdivision engineer has certified to the Commission that the layout of all public improvements is in accordance with the construction plans for the subdivision. The Town Council shall thereafter accept the improvements for dedication in accordance with the established procedure.
   (B)   Prior to any street or other improvement being accepted by the town as hereinafter provided, the subdivider shall post a maintenance bond or other security naming the town as obligee in an amount not to exceed 10% of the cost of all public improvements in order to ensure the maintenance of said improvements for a period of at least 36 months from the date of acceptance by the town.
