§ 94.01 TIME OF USE RESTRICTIONS.
   (A)   The use of fireworks, whether consumer or commercial, which produce bangs, pops or whistles in excess of normal fire burning or which produce sparks, excepting from sparklers, snap-pops and party poppers, within the town limits shall be limited and restricted as follows:
      (1)   Between the hours of 10:00 a.m. and 11:00 p.m. on July 1, July 2, July 3, July 5, July 6 and July 7;
      (2)   Between the hours of 10:00 a.m. and 12:00 a.m. (midnight) on Memorial Day, July 4 and Labor Day;
      (3)   Between the hours of 10:00 a.m. and 1:00 a.m. on December 31; and
      (4)   Any other time authorized by the Town Council in writing.
   (B)   Nothing in this section shall prohibit the local Fire Chief, the state’s Fire Marshal, the Town Marshal or any duly-authorized law enforcement official from further restricting or prohibiting the use of fireworks during the aforementioned periods of time for any weather-related or public safety reasons.
