(A) Enforcement Authority. The President of the Town Council or his or her designee, as the Enforcement Authority, shall be authorized to administer and to proceed under the provisions of this subchapter in ordering the removal of any weeds or rank vegetation found to be in violation of this subchapter.
(B) Powers. Wherever in this subchapter or under applicable state statute it is provided that anything must be done to the approval of or subject to the discretion of the Enforcement Authority, this shall be construed to give said Enforcement Authority only the discretion of determining whether the rules and standards established by ordinance or statue have been complied with. No such provisions shall be construed as giving the Enforcement Authority discretionary powers as to what such regulations or standards shall be, the power to require conditions not prescribed by ordinance or statue or the power to enforce such provisions in an arbitrary or capricious manner.
