§ 91.50 VIOLATION NOTIFICATION.
   (A)   Whenever a police officer, volunteer firefighter or other authorized person of the town shall find that the owner or operator of any alarm system has committed any of the acts which have been declared unlawful by any provision of this chapter, the officer, volunteer firefighter or other authorized person shall give notice to said owner or operator of the violation in the manner directed in divisions (B) through (E) below.
   (B)   A police officer, volunteer firefighter or other authorized person of the town shall notify the owner or operator of an alarm system or his or her representative of any violation subject to this chapter by presenting the person found in possession of or in charge of the alarm system with a written notice. If the officer, volunteer firefighter or other authorized person shall not find any person in possession or in charge of the premises, or if the person is a child or incapable of receiving the notice, then the officer or volunteer firefighter shall notify the owner or operator thereof by posting or attaching a written notice of the violation in a conspicuous place upon the premises, and the person shall be bound thereby.
   (C)   All notices of violations as required by this section shall be executed in triplicate by a police officer, volunteer firefighter or other authorized person of the town. One copy shall be served upon the violator, one copy shall be filed by the officer, volunteer firefighter or other authorized person with the town and one copy shall be filed in the office of the Town Attorney. The latter two copies shall be filed by the respective officer, volunteer firefighter or other authorized person at his or her earliest opportunity before or when he or she goes off duty for the particular day on which the notice was served on the violator.
   (D)   All notices provided for in this section shall be numbered and shall contain the following information:
      (1)   The specific violation with which the violator is charged;
      (2)   The name and address of the person who controls the property on which the alarm system is installed;
      (3)   The location of the violation;
      (4)   The signature of the officer, volunteer firefighter or other authorized person;
      (5)   The badge number, if any, of the officer; and
      (6)   The date of the violation.
   (E)   The copy of the notice served upon the violator, his or her representative or the owner of the premises shall also state that the violator or the other person, after the first false alarm in the calendar year of permit, shall appear in person or by attorney or agent at the office of the Town Hall at 112 North Meridian Street, Greentown, Indiana, within five days of the date of the violation appearing upon the notice. The violator so appearing shall have the privileges accorded by law. However, if the period of five days shall expire upon a Sunday or a legal holiday, then the period of time in which the violator must appear shall be extended an additional 24 hours.
