SCHEDULE IV. RECREATIONAL AND TOY VEHICLES.
   (A)   Snowmobiles.
      (1)   This division (A) incorporates the provisions of I.C. 14-16-1 et seq. by reference as the same may be in effect and amended from time to time.
      (2)   No person shall operate a snowmobile upon a public street or right-of-way thereof within one block south or north from the point where Meridian Street intersects with Main Street.
      (3)   No person shall operate a snowmobile upon SR 213 from the point where SR 213 intersects with U.S. 35 within the town limits.
      (4)   No person shall operate a snowmobile upon U.S. 35, commonly known as Main Street, nor upon the right-of-way thereof.
      (5)   No person shall operate a snowmobile:
         (a)   At a rate of speed greater than is reasonable and proper having due regard for the conditions then existing; or
         (b)   In no event, at a rate of speed greater than the posted speed limit for other vehicular traffic.
   (B)   Toy vehicles.
      (1)   No person shall ride or operate any bicycles, skateboards, roller skates, in-line skates or scooters upon a sidewalk within the following streets in the town:
         (a)   One block north of the intersection of Main Street and Meridian Street to Grant Street; or
         (b)   One-half block east, west or south of the intersection of Main Street and Meridian Street.
      (2)   Where named vehicles or devices are permitted to be operated upon sidewalks, the operator of the vehicle or device shall yield the right-of-way to any pedestrians.
   (C)   Penalties.
      (1)   General. Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
      (2)   Toy vehicle violations. Toy vehicle violations shall be subject to a maximum fine of $50.
         (a)   First offense. Upon the first violation hereof, the bicycle, skateboard, roller skates, in-line skates or scooter of the offending party who was riding or otherwise operating the same shall be confiscated by the Town Marshal or his or her deputies and held by the Town Marshal for a period of five days. After said time, said item shall be returned to such party or to the parent or guardian of a juvenile party.
         (b)   Second offense. Upon the second violation hereof, the bicycle, skateboard, roller skates, in-line skates or scooter of the offending party who was riding or otherwise operating the same shall be confiscated by the Town Marshal or his or her deputies and held by the Town Marshal for a period of five days, and the offending party shall be fined in an amount not to exceed $25. After said time, said item shall be returned to such party or to the parent or guardian of a juvenile party.
         (c)   Subsequent offenses. Upon all subsequent violations hereof, the bicycle, skateboard, roller skates, in-line skates or scooter of the offending party who was riding or otherwise operating the same shall be confiscated by the Town Marshal or his or her deputies and held by the Town Marshal for a period of 30 days, and the offending party shall be fined an amount not to exceed $50. After said time, said item shall be returned to such party or to the parent or guardian of a juvenile party.
