§ 153.99 PENALTY.
   Any person in violation of this chapter may be punished in accordance with the provisions of IC 36-1-3-8, specifically, a fine of not less than $500, nor more than $2,500, for the first day of the violation, which fine shall be assessed by the Planning Commission. Each day a violation exists constitutes a continued violation and each day the violation continues to exist and additional $500 per day shall be added to the fine. The fines provided for in this chapter shall not apply to any violation that is corrected by the person responsible for the violation within 10 days of its disclosure and reasonable notification. The city, acting through the Planning Commission Director, may in the name of the city bring certain actions for the recovery of all costs and fines assessed herein and to also bring action for the mandatory and injunctive relief for the enforcement of, and to secure compliance with, any provisions of this chapter. In addition to the recovery of the actual costs, fines and expenses incurred by the city, the city shall also be entitled to recover all expenses incurred, including, but not limited to, all attorney fees and court costs incurred by the city in bringing any enforcement action.
