Any dealer who violates the prohibition of § 113.01 shall be subject to a fine of up to $1,000 per day for each day said dealer is in violation of this section. The city acting through the Planning Commission Director may in the name of the city bring certain action in the Circuit Court or Superior Court of Decatur County for recovery of all fines and costs incurred by the city in enforcing the terms of this chapter. In addition, the city or any person may bring an action for the mandatory and injunctive relief and for the enforcement of and to secure compliance with any provisions of this chapter. If it is determined that any person attempts or does violate any of the provisions of this chapter including the payment of fines and costs then that person or persons shall be required to pay all litigation expenses, court costs, and attorney fees of the city or of any party or parties seeking to enforce the provisions of this chapter which expenses shall include the recovery of all costs and expenses including but not limited to all attorney fees and litigation expenses.
