§ 50.032 RATES AND CHARGES.
   (A)   (1)   Effective January 1, 2022. For the use of the service rendered by the sewage works, rates and charges shall be collected from the owners of each and every lot, parcel of real estate, or building that is connected with the city sanitary system or otherwise discharges sanitary sewage, industrial wastes, water, or other liquids, either directly or indirectly, into the sanitary sewage system of the City of Greensburg. Such rates and charges include user charges, debt service costs, excessive strength surcharges, and other service charges, which rates and charges shall be payable as hereinafter provided and shall be in an amount determined as follows:
         (a)   The sewage rates and charges shall be based on the quantity of water used on or in the property or premises subject to such rates and charges as the same may be measured by the water meter there in use, plus a base charge based on the size of water meter installed, except as herein otherwise provided. For the purpose of billing and collecting the charges for sewage service, the water meters shall be read monthly, and the users shall be billed each month (or period equaling a month). The water usage schedule on which the amount of said rates and charges shall be determined is as follows:
            All Class I Users.

Sewage service bills shall be rendered once each month (or period equaling a month). The schedule on which said rates and charges will be determined is as follows:

         (c)   For the service rendered to the City of Greensburg, said city shall be subject to the same rates and charges established in harmony therewith.
   (B)   In order to recover the cost of monitoring industrial wastes, the city shall charge the user not less than $83.25 per sampling event plus the actual cost for collecting and analyzing the sample(s) as determined by the city or by an independent laboratory in Phase I, beginning January 1, 2022; and not less than $91.60 per sampling event plus the actual cost for collecting and analyzing the sample(s) as determined by the city or by an independent laboratory in Phase II, beginning January 1, 2023; and not less than $91.60 per sampling event plus the actual cost for collecting and analyzing the sample(s) as determined by the city or by an independent laboratory in Phase III, beginning January 1, 2024. This charge will be reviewed on the same basis as all other rates and charges in this section.
   (C)   Wastewater haulers (as defined elsewhere in this chapter) shall be charged a fee of $40 per 1,000 gallons of septic waste in Phase I, beginning January 1, 2022; and $45 per 1,000 gallons of septic waste in Phase II, beginning January 1, 2023; and $45 per 1,000 gallons of septic waste in Phase III, beginning January 1, 2024. These charges shall be paid at the Greensburg Water Office prior to discharge in the plant.
   (D)   In order that domestic and residential users of sewage services shall not be penalized for the sprinkling of lawns during the months of June, July, August and September, the billing for treatment plant sewage service for residences and/or domestic users for said months of June, July, August, and September shall be based on the water usage for the previous months of November, December, January and February. In the event the water usage for said previous month of November, December, January, and February is greater than the water usage for said months of June, July, August, and September, then the billing for sewage service shall be computed on the actual water used in the month for which the sewage service bill is being rendered. Domestic and/or residential sewage service, as applicable to the sprinkling rate, shall apply to each lot, parcel of real estate or building which is occupied and used as a residence. Said sprinkling rate shall not apply to any premises which are partially or wholly used for commercial or industrial purposes. The owner shall have the privilege of separating the water service so that the residential portion of the premises is served through a separate meter, and in such case, the water usage as registered by the water meter serving such portion of the premises used for residential purposes would qualify under the sprinkling rate.
   (E)   Rate surcharges based on strength and character of discharges.
      (1)   Effective January 1, 2022. In order that the rates and charges may be justly and equitably adjusted to the service rendered to users, the city shall base its charges not only on the volume, but also on strength and characters of the stronger-than-normal domestic sewage and wastes which it is required to treat and dispose of. The city shall require the user to determine the strength and content of all sewage and wastes discharged, either directly or indirectly, into the sanitary sewage system, in such manner, by such method, and at such times as the city may deem practicable in light of the conditions and attending circumstances of the case, in order to determine the proper charge. The user shall furnish a central sampling point available to the city at all times.
         (a)   Normal sewage domestic waste strength should not exceed a carbonaceous biochemical oxygen demand of 200 milligrams per liter of fluid, ammonia (or TKN) in excess of 20 milligrams per liter of fluid, or suspended solids in excess of 200 milligrams per liter of fluid. Additional charges for treating stronger-than-normal domestic waste shall be made on the following basis:
            1.   Rate surcharge based upon suspended solids. There shall be an additional charge of $0.27 per pound of suspended solids for suspended solids received in excess of 200 milligrams per liter of fluid.
            2.   Rate surcharge based upon CBOD. There shall be an additional charge of $0.22 per pound of carbonaceous biochemical oxygen demand for BOD received in excess of 200 milligrams per liter of fluid.
            3.   Rate surcharge based upon Total Kjeldahl Nitrogen (TKN). There shall be an additional charge of $0.54 per pound of TKN for TKN received in excess of 20 milligrams per liter of fluid.
         (b)   The determination of suspended solids, five-day carbonaceous biochemical oxygen demand, biochemical oxygen demand, ammonia-nitrogen, phosphorus, ammonia, and COD contained in the waste shall be in accordance with the latest copy of "Standard Methods for the Elimination of Water, Sewage, and Industrial Wastes" as written by the American Public Health association, the American Waterworks Association, and the Water Pollution Control Federation, and in accordance with "Guidelines Establishing Test Procedures for Analysis of Pollutants", 40 CFR, Part 136.
      (2)   Effective January 1, 2023. In order that the rates and charges may be justly and equitably adjusted to the service rendered to users, the city shall base its charges not only on the volume, but also on strength and characters of the stronger-than-normal domestic sewage and wastes which it is required to treat and dispose of. The city shall require the user to determine the strength and content of all sewage and wastes discharged, either directly or indirectly, into the sanitary sewage system, in such manner, by such method, and at such times as the city may deem practicable in light of the conditions and attending circumstances of the case, in order to determine the proper charge.    (F)   Sewer connection fee.
      (1)   No connection to the city’s sewage works system shall be allowed until a payment of a sewer connection fee has been made to the city.
         (a)   “Sewer connection fee” is the charge to a user for a new connection to or additional wastewater discharge from an existing connection to the city’s sewage works system and is charged as a pro rata cost of construction of all interceptor, local and lateral sewer lines and appurtenances to serve the property of the connecting user and is charged in return for the city making available to such user the city’s sewage treatment system consisting of all facilities and operations necessary to treat sewage of such user. The amount of the connection fee shall be as follows:

         (b)   Equivalent dwelling unit (EDU) is defined as the design average use of 310 gallons per day or 9,300 gallons of wastewater per month over one calendar year. EDU determinations for wastewater dischargers other than single-family dwellings shall be determined in accordance with Table 1.

      (2)   Line extensions to accommodate a single-family or multi- family dwelling, municipal, commercial, or industrial establishment shall be the responsibility of the developer or owner of such property.
      (3)   Payment of the sewer connection fee shall be made at the following times:
         (a)   For new construction connections, the sewer connection fees shall be paid in full at the time of requesting a building permit and must be paid in full before issuance of a building permit. The amount to be paid at the time of permit issuance shall be the amount set forth in subsection (b) for the wastewater discharge specified at the time of permit issuance for the usage and building type being proposed at the time of the permit request; and
         (b)   For all existing sewage connections with additional wastewater usage, the sewer connection fee shall be paid in full before the additional discharge is made to the city’s sewage system.
         (c)   The individual seeking the building permit bears the responsibility to ensure payment of the applicable sewer connection fees prior to application for a building permit and no permit will be issued without confirmation of payment of the sewer connection fees.
         (d)   This amendment to the subchapter shall be retroactive such that all prior plat or plan approvals obtained prior to this amendment where such fees have not been previously paid are not required to be paid until such the time of requesting a building permit and must be paid in full before the issuance of a building permit. The amount to be paid at the time of permit issuance shall be the amount set forth in subsection (b) for the wastewater discharge specified at the time of permit issuance for the usage and building type being proposed at the time of the permit request.
         (e)   For all services where the fees were previously paid at the time of plat or plan approval, no additional fees will be assessed at the time of requesting a building permit, provided the wastewater discharge is the same as the wastewater discharge that was used to compute the original fee amount. If a larger wastewater discharge is requested at the time of issuance of the building permit, an additional fee in the amount of the difference in fees for the wastewater discharge requested versus the wastewater discharge used to compute the initial fee, based upon the amounts set forth in subsection (b) for the wastewater discharge specified at the time of permit issuance.
   (G)   (1)   For the purpose of this division, an equivalent residential unit (ERU) is defined as the amount of impervious area included upon an average residential property. An impervious area refers to those surface areas of residential and non-residential properties which water will not penetrate and from which stormwater runoff will be produced. An impervious area of not more than 3,000 square feet shall constitute one ERU.
      (2)   Definitions. For the purposes of this division, the following terms shall have the specified meaning.
         "CLASS I." Any parcel existing within or later annexed into the corporate limits of the City of Greensburg and any parcel now existing in or later added to the City of Greensburg, Indiana sewage works system service area considered to be agricultural or residential. This shall include duplexes, triplexes, mobile homes and condominiums.
         "CLASS II." Any parcel existing within or later annexed into the corporate limits of the City of Greensburg and any parcel now existing in or later added to the City of Greensburg, Indiana sewage works system service area considered to be unimproved parcels. Unimproved parcels include, but are not necessarily limited to, unimproved agricultural parcels, unimproved residential parcels, unimproved commercial parcels, unimproved industrial parcels, unimproved tax-exempt parcels, unimproved municipal parcels, and unimproved utility parcels.
         "CLASS III." All parcels existing within or later annexed into the corporate limits of the City of Greensburg and any parcel in or later added to the City of Greensburg, Indiana sewage works system service area considered to be public street right-of-way and/or portions of parcels existing within or later annexed into the corporate limits of the City of Greensburg and any parcel in or later added to the City of Greensburg, Indiana sewage works system service area considered to be public street right-of-way. Where a parcel has a portion of its area considered to be public street right-of-way, the remainder of that parcel shall be classified as defined in this division.
         "CLASS IV." All parcels not encompassed within the definitions of Class I, Class II, and Class III. This includes, but is not necessarily limited to, commercial parcels, industrial parcels, tax-exempt parcels, municipal parcels, and utility parcels.
      (3)   This section is hereby amended to make provisions for a monthly stormwater fee. For all parcels defined as Class I, the monthly stormwater fee is to be paid by each utility customer with a utility service account for utilities other than stormwater on the parcel, and for all parcels defined as other than Class I and for parcels defined as Class I but without a utility service account for utilities other than stormwater, the monthly stormwater fee is to be paid by each property owner.       (4)   Because properties identified as Parcel Id Numbers 16-06- 20-340-006.000-017, 16-06-28-330-010.000-016,16-06-29-120-003.000-016, 16-06-29-210-002.000-016, 16-06-30-140-002.000-018, 16-06-32-110- 002.000-016, 16-06-33-220-004.000-016 and 16-06-34-330-015.000-016 generally are outside of the drainage basins of Muddy Fork Creek, Gas Creek and Sand Creek which flow through the corporate boundaries of the City of Greensburg and also because those properties have existing stormwater facilities that exceed the minimum requirements of the City of Greensburg, they will each be assessed one ERU for every 9,000 square feet of impervious area with an initial monthly fee per ERU of $3.50 and an initial total monthly fee that is variable as calculated by multiplying the number of ERUs times the monthly fee per ERU. Said adjusted rate of ERUs shall remain in effect until such time as the City Engineer and/or the Director of Public Projects and city's MS4 Coordinator mutually determine that the property owners do not continue to maintain stormwater facilities that exceed the minimum requirements of the City of Greensburg. At such time, those properties will be designated as Class IV property and assessed their fee as set forth in division (3).
      (5)   Because properties identified as Parcel Id Numbers 16-10- 16-000-007.020-015, 16-10-16-000-008.000-015, 16-10-16-000-009.000-015, 16-10-16-000-010.000-015, 16-10-17-000-013.020-015, 16-10-17-000- 014.010-015, 16-10-17-000-015.000-015, 16-10-17-340-012.020-015, 16-10- 20-000-001.000-015, 16-10-20-000-002.000-015, 16-10-20-000-002.010-015, 16-10-20-000-003.000-015, 16-120-000-004.000-015, 16-10-20-000-004.040- 015, 16-10-20-000-011.000-015, 16-10-20-000-012.000-015, 16-10-20-000- 012.020-015, 16-10-20-000-012.030-015, 16-10-20-210-013.010-015, 16-10- 21-000-006.010-015, 16-10-21-000-007.000-015, 16-10-21-000-007.010-015, 16-10-21-000-007.040-015 are outside of the drainage basins of Muddy Fork Creek, Gas Creek and Sand Creek which flow through the corporate boundaries of the City of Greensburg, they will not be assessed any stormwater fee.
      (6)   On January 1 of each year, beginning in 2023, a 3% Cost of Living Adjustment (COLA) shall be added to the previous year's rates and charges. This 3% increase shall occur automatically each year unless and until such time that the City of Greensburg City Council amends or adjust the percentage of the COLA increase for the next fiscal year.
      (7)   Rates and charges incurred under this division shall be prepared and collected by City of Greensburg Utility Office in accordance with those provisions regulating the preparation and issuance of utility bills. For parcels defined as Class I and having one or more utility service accounts the monthly fee for Class I property shall be included on each utility invoice for that parcel as a separate itemization for stormwater fee. The user fee shall be due and payable at the same time as the utility bill. For parcels defined as other than Class I and for parcels defined as Class I but having no other utility service account, the monthly fee shall be invoiced on a separate invoice mailed to the property owner. The user fee shall be due and payable 17 days after the date of the invoice. Failure to pay the user fee by the due date will result in the assessment of a 10% late fee being added to the account. The monies collected under this division shall be deposited in the City of Greensburg Stormwater Revenue Fund hereby created.
      (8)   If, in the opinion of any user, the class assigned to his or her property is inaccurate and/or the number of ERUs assigned to his or her property is inaccurate in light of the amount of impervious surface area found on the property, the user shall have the right to contest the ERU determination and thus the rate assessed in the following manner:
         (a)   The user shall obtain and complete a petition to appeal the stormwater rate and return it to the City Engineer and/or the Director of Public Projects with verifiable documentation supporting the user's claim.
         (b)   The City Engineering Department shall investigate the user's claim.
         (c)   Upon review thereof, the City of Greensburg Board of Public Works shall hold a public hearing. The user and the Stormwater Division shall have the opportunity to submit additional written documentation in support of each position prior to the meeting. The Board shall conduct a hearing on the dispute and issue a determination within 60 days, which shall be binding on the Stormwater Division and the user. The hearing shall be electronically recorded, and a transcript of the hearing provided upon request at a cost per page as determined by the City of Greensburg Clerk/Treasurer.
         (d)   A party or person aggrieved by the final Board determination shall have the right to judicial review of the determination in accordance with state law.
         (e)   If reduction is ordered by the Board or court of law, the user shall be credited accordingly for any overpayment made from the date of the petition.
         (f)   Dispute or appeal of an ERU determination for the stormwater user fee shall not be a valid reason for non-payment of the originally assessed stormwater user fee by the user.
      (9)   A stormwater utility user fee credit manual, when approved by resolution of the City of Greensburg Board of Works, will provide for non-residential property owners to reduce their stormwater utility fee in exchange for their efforts to reduce the impacts of stormwater runoff from their property on the public infrastructure and waterways. When stormwater best management practices are implemented by property owners in conformance with the provisions of the approved stormwater utility user fee credit manual, their annual assessed fee shall be reduced as set forth in the manual. The Board of Works may from time to time and by resolution amend the provisions of the stormwater utility user fee credit manual.
