4-3-4: EXCEPTIONS:
   A.   General Exception: No act which is done or maintained under the express authority of an authoritative statute, ordinance, conditional use permit or court ruling shall be declared a nuisance.
   B.   Agricultural Exception: Agricultural operations that are consistent with sound agricultural practices are presumed to be reasonable and do not constitute a nuisance under this chapter unless the agricultural operation has a substantial adverse effect on the public health and safety. As used herein, "agricultural operation" means any facility for production for noncommercial or commercial purposes of crops, livestock, and poultry. This also includes any vehicle used or stored for agricultural purposes or operations. (Ord. 2009-04, 2-10-2009, eff. 2-10-2009)
