(A) Establishment of Board. Pursuant to I.C. 36-10-3-1 et seq. and this subchapter, there is hereby established a Board of Parks and Recreation.
(B) Organization of Board. The Board of Parks and Recreation shall be comprised of five members, which shall include the following:
(1) Four members selected and appointed by the Mayor based upon their respective interest in and knowledge of parks and recreation;
(2) One member shall be selected by the Board of School Trustees;
(3) At its first regular meeting in each year, the Board of Parks and Recreation shall elect a President and a Vice-President. The Vice-President shall have authority to act as the President of the Board during the absence or disability of the President; and
(4) Members initially appointed to the Board of Parks and Recreation shall serve for four- year terms: one for a term of one year; one for a term of two years; one for a term of three years; and one for a term of four years. Thereafter as a term expires, each new appointment shall be for a four-year term. All terms shall expire on the first Monday in January, but an appointee shall continue in office until his or her successor is appointed.
(C) Powers, duties, and responsibilities of Board. The Board of Parks and Recreation shall have the following powers, duties, and responsibilities:
(1) The power to perform all acts necessary to acquire and develop sites and facilities to conduct such programs as are generally understood to be park and recreation functions;
(2) The duty to administer the Department of Parks and Recreation, including the power to oversee the Superintendent, and such other personnel as the Board may determine to be necessary;
(3) The duty to prepare and submit an annual budget in the same manner as other departments of the city government;
(4) The power to accept gifts, donations, and subsidies for park and recreation purposes; and
(5) The power to create an Advisory Common Council and special committees composed of citizens interested in the problems of parks and recreation in accordance with state law.
