§ 93.21 PROHIBITED FORMS OF WASTE DISPOSAL.
   (A)   It shall be unlawful for any person, firm, or corporation to throw or deposit or allow or permit any child, servant, member of the family, or any other person under his, her, or their control to throw or deposit any manure, rubbish, slops, putrid or unsound animal or vegetable matter, or any filthy, noisome, or unwholesome liquid slops or substances that are liable to become unwholesome in, into, or on any street, lane, alley, sidewalk, gutter, crossing, lot, cellar, premises, or commons within the city.
   (B)   It shall be unlawful for any person, firm, or corporation to deposit, or in any manner place on any street, alley, or public property within the corporation limits of the city any ashes, garbage, junk, slop, fencing, or any other substances, materials, or structures that would, in any manner, interfere with the free use of any streets or alleys within the corporation limits of the city, or which, in any manner, would interfere with or mar the appearance of such streets or alleyways within the corporation limits of the city.
   (C)   It shall be unlawful to deposit or place any garbage or rubbish in any alley, street, river, canal, stream, drainage ditch, or other public place within the city, provided that nothing in these regulations shall be construed to prohibit the hauling and dumping of ashes, cinders, dirt, sand, stone, brick, or gravel which are free of trash, rubbish, refuse, or garbage to or on any lot owned or at the request of the owner for the purpose of elevating the grade of such lot or for the improvement thereof. Nothing in these regulations shall be construed to prohibit the hauling or transporting of saleable metals, scrap, rubber, paper, rags, or glass to junkyards, reclamation yards, or any other places buying or handling the same.
   (D)   Except for the placement of approved garbage receptacles from 6:00 p.m. on the day prior to refuse collection for the subject property until 12:00 p.m. on the day after refuse collection from the subject property, no owner or occupant of a property shall locate any garage receptacle in the right-of-way.
   (E)   On the failure of any person, firm, or corporation to perform any of the foregoing provisions of this section, the Building Commissioner, or the Building Commissioner’s designee, shall cause a written order to be served on such person, firm, or corporation requiring such duty to be performed within seven days.
