Any duly authorized business operating in a building by virtue of fee ownership thereof or a leasehold interest therein is hereby authorized to conduct such duly authorized business upon any sidewalk immediately adjacent thereto, provided that:
(A) Such building is located on State Road 9 between North Street and South Street or on U.S. 40 between Noble Street and Spring Street; and
(B) Any structures or appurtenances for the display or sale of goods, wares, or merchandise are located to maintain five feet between such structure or appurtenance and the edge of the sidewalk nearest to the street.
