§ 52.074 ENFORCEMENT.
   (A)   Every customer shall be subject to the enforcement provisions provided in this subchapter except for the City Fire Department, and any state licensed health care provider(s) which are or have been declared accepted by the Board.
   (B)   Any person determined to have violated the terms of a declaration of necessity for a Level 2 water conservation shall be subject to a first-time written warning by either the City Police Department, an employee of the water utility, or such other authorized and designated employee of the city. In the event said customer is determined to have continued to violate the terms and conditions of a declaration for necessity for a Level 2 water conservation measure, that person shall be cited with a written citation and subject to a fine up to $2,500 plus costs, expenses, and fees, including the reasonable attorney’s fees of the city.
   (C)   Any person who is determined to have violated the terms and conditions of a Level 3 or 4 water conservation emergency shall be cited by the City Police Department or water utility, or such other duly authorized and designated employee of the city, with violation of this subchapter. A fine may be imposed against said violator in the sum up to $2,500 plus costs, expenses, and fees, including the reasonable attorney’s fees of the city. Additionally, the water utility shall disconnect the water service to any such customer, at the time the citation is issued, or as soon thereafter as possible. Continuation of water service shall be recommended upon the payment of a reconnection fee of $100.
