141.07 DISPOSITION OF UNCLAIMED AND FORFEITED PROPERTY.
   (a)   Unclaimed and forfeited property in the custody of the Police Department, other than contraband that is subject to the provisions of Ohio R.C. Chapter 2981, other than property forfeited under Ohio R.C. 2925.42, other than property that has been lawfully seized in relation to the violation of Ohio R.C. 2923.32, other than a vehicle that is criminally forfeited under an order issued under Ohio R.C. 4503.233 or 4503.234 and that is to be disposed of under Ohio R.C. 4503.234, shall be disposed of on application to an order of a court of competent jurisdiction in Highland County. This shall be done as follows:
      (1)   Drugs shall be disposed of pursuant to Ohio R.C. 3719.11 or shall be placed in the custody of the Secretary of the Treasury of the United States for disposal or use for medical or scientific purposes under applicable federal law.
      (2)   Firearms and dangerous ordnance suitable for police work may be given to the Greenfield Police Department for that purpose. Firearms suitable for sporting use or as museum pieces or collector’s items may be sold at public auction pursuant to subsection (b) herein. Other firearms and dangerous ordnance not suitable to police use or sale may be destroyed or sent to the Bureau of Criminal Identification and Investigation for destruction, pursuant to Ohio R.C. 2981.12.
      (3)   Obscene materials shall be destroyed.
      (4)   Vehicles used in violation of Ohio R.C. 2925.13(A) shall be seized and forfeited to the Village as set forth in Ohio R.C. 2981.12(A)(6). Such forfeiture shall not apply to common carriers or innocent owners, nor shall it affect the rights of a holder of a valid lien.
      (5)   A.   Any mobile instrumentality that has been forfeited may be taken by the Greenfield Police Department for use in performing its duties. The Greenfield Police Department shall take the mobile instrumentality subject to any security interest or lien on the mobile instrumentality.
         B.   Vehicle and vehicle parts forfeited under Ohio R.C. 4549.61 to 4549.63 may be given to the Greenfield Police Department for use in the performance of its duties. Such parts may be incorporated into any other official Village vehicle. Parts that do not bear vehicle identification numbers or derivatives thereof may be sold or disposed of as provided by rules of the Director of Public Safety. Parts from which a vehicle identification number or derivative thereof have been removed, defaced, covered, altered or destroyed and that are not suitable for police work or incorporation into an official vehicle shall be destroyed and/or sold as junk or scrap.
      (6)   Any beer or intoxicating liquor or alcohol seized from a person who does not hold a permit issued under Chapters 4101 and 4103 of the Ohio Revised Code or otherwise forfeited, shall be disposed of in accordance with Ohio R.C. 2981.12(A)(4). Any beer, intoxicating liquor or alcohol that the Police Department determines to be unfit for sale shall be destroyed.
      (7)   Computers, computer networks, computer systems and computer software suitable for police work may be used by the Police Department for that purpose or disposed of under subsection (a) of this section.
      (8)   Money seized in connection with a violation of Ohio R.C. 2905.32, 2907.21 or 2707.22 shall be deposited in the victims of human trafficking fund created by Ohio R.C. 5101.87.
   (b)   Unclaimed or forfeited property that is not described in subsection (a) hereof, with court approval, may be used by the Greenfield Police Department. If it is not used by the Police Department, it may be sold without appraisal at a public auction to the highest bidder for cash or disposed of in another manner that the court considers proper.
