The BOCA National Property Maintenance Code is amended and revised in the following respects:
(a) Section PM-101.1 TITLE. These regulations shall be known as the Property Maintenance Code of the City of Greenfield hereinafter referred to as the “Code”.
(b) Section PM-106.2 PENALTY. Any person who shall violate a provision of this code shall, upon conviction, be subject to a fine not to exceed one hundred dollars ($100.00) at the discretion of the Court. Each day that a violation continues after due notice has been served shall be deemed a separate offense.
(c) Section PM-304.15 INSECT SCREENS. Every door, window and other outside opening utilized or required for ventilation purposes serving any structure containing habitable rooms, food preparation areas, food service areas, or any area where products to be included or utilized in food for human consumption are processed, manufactured, packaged or stored, shall be supplied with approved tightly fitting screens of not less than 16 mesh per inch and every swinging door shall have a self-closing device in good working condition.
EXCEPTION: Screen doors shall not be required for out-swinging doors or other types of openings which make screening impractical, provided other approved means, such as air curtains or insect repellent fans are employed.
(d) Section PM-602.2.1 HEAT SUPPLY. Every owner and operator of any building who rents, leases or lets one or more dwelling unit, rooming unit, dormitory or guestroom on terms, either express or implied, to furnish heat to the occupants thereof shall supply sufficient heat to maintain the room temperatures of not less than 70 degrees F. during the hours between 6:30 a.m. and 10:30 p.m. of each day and not less than 60 degrees F. during other hours.
(e) Section 602.3 NONRESIDENTIAL STRUCTURES. Every enclosed occupied work space shall be supplied with sufficient heat to maintain a temperature of not less than 65 degrees F. during all working hours.
Exception 1. Processing, storage and operation areas that require cooling or special temperature conditions.
Exception 2. Areas in which persons are primarily engaged in vigorous physical activities. (Ord. 26-97. Passed 12-3-97.)
(f) Section PM-107.6 SERVICE BY LAW ENFORCEMENT PERSONNEL. In addition to notices and orders to be given by the Code Official, notices, citations, and orders for violations of Section PM-306 and subsections thereof may be issued and served by law enforcement personnel in the manner provided for hereunder.
