Any person, firm, corporation, or other entity who maintains or operates or who controls the maintenance of a solar energy facility in violation of this chapter shall be guilty of a misdemeanor and subject to prosecution, and if convicted, shall be punished by a fine not to exceed $50 or by imprisonment not to exceed 30 days, or both, in the discretion of the court. Each day that said solar energy facility shall be maintained or operated in violation of this chapter shall constitute a separate and distinct offense.
