§ 151.083  DRAINAGE AND SEDIMENTATION CONTROL.
   (A)   Easements. Where a subdivision is traversed by a water course, drainage way, channel, or stream, there shall be provided a storm water easement or drainage right-of-way conforming substantially with the lines of such watercourse and such further width or construction, or both, as will be adequate for the purpose of managing storm water runoff in a manner following the natural contours of the watercourse that will safeguard the health and property of the citizens of the county. Maintenance responsibility for drainage shall be included in the covenants of the subdivision and enforced by the homeowners’ association.
   (B)   Sedimentation and erosion control. Persons engaged in land disturbing activities shall take all reasonable measures to protect all public and private property from damage by such activities. When any land disturbing activity is to be undertaken on a tract where more than one acre is to be uncovered, a sedimentation and erosion control plan is required. Vegetated buffer strips of at least 15 feet, where practicable, shall be retained in their natural state along the banks of all watercourses, bodies of water or wetlands. Subdividers shall comply with state regulations.
