(A) Applicability. Division (B) shall apply to all persons confined to the county jail who receive medical, dental, eye or any other health care related services during such person’s period of confinement, except the following:
(1) A person confined to the county jail who maintains a policy from a private company covering medical care, dental care, eye care or other health care related service, or who is willing to pay for such person’s own medical care; or
(2) A person confined to the county jail who:
(a) Does not have funds in the person’s commissary account or trust account at the time the service is provided, or within 60 days after the service is provided;
(b) The service is provided in an emergency;
(c) The services is provided as a result of an injury received in the county jail; or
(d) The service is provided at the request of the Sheriff or Jail Administrator.
(B) Establishment of schedule of copayments. The County Sheriff is hereby authorized and empowered to establish and, from time to time, to amend a schedule of inmate copayments for the provision of any medical, dental, eye, or other health care related service. The copayment established may not exceed $15 for each service, or the maximum copayment allowable under I.C. 11-12-5-5, whichever sum is greater. The Sheriff shall provide a copy of the schedule of inmate copayments to the County Auditor following the establishment or amendment of the same.
(C) Collection of copayments. Within 60 days from the date the services are provided, the County Sheriff shall collect inmate copayments as provided under this section from the commissary account or inmate trust account of the inmate who received such services. The copayments so collected shall be forwarded at least monthly to the County Auditor for deposit into the County Medical Care for Inmates Fund.
(D) Maintenance of County Medical Care for Inmates Fund. The County Auditor shall maintain a County Medical Care for Inmates Fund and deposit into such funds all copayments received from inmates as the result of the provision of medical, dental, eye or other health care related services.
(E) Restriction on use of Funds. The County Medical Care for Inmates Fund shall be utilized solely to offset expenditures from the county general fund for the provision of medical, dental, eye or other health related care provided to inmates of the county jail.
