(A) This section shall be known as the “Property Endorsement Fee Ordinance”.
(B) The Board of Commissioners of the county herein establishes the “Plat Book Maintenance Fund”, as a dedicated fund for use in maintaining plat books, as provided in I.C. 36-2-9-18.
(C) The Auditor of the county is hereby authorized to assess, collect and directed to deposit into the Fund a fee not to exceed that allowed by state law for the legal description of each parcel contained in every deed for which the Auditor makes a real property endorsement.
(D) All funds collected in the Plat Book Maintenance Fund shall be expended solely for the purposes set forth in I.C. 36-2-9-18, and for no other purposes.
(E) The Auditor of the county is directed to publish a copy of this section in newspapers of general circulation, as provided in I.C. 5-3-1 et seq., and shall commence assessment of property endorsement fees on or after 30 days following publication of this section or 11-1-2003, whichever date is sooner.
