§ 32.01  EMS EQUIPMENT PURCHASE AND REPLACEMENT FUND.
   (A)   Establishment of the EMS Equipment Purchase and Replacement Fund. The Board of Commissioners hereby establishes a fund that shall be known as the “EMS Equipment Purchase and Replacement Fund” (“the EMS Fund”).
   (B)   Deposits. The County Auditor is authorized and directed to deposit into the EMS Fund, from revenues derived from the provision of emergency medical services by the EMS, the fixed sum of $9,000 per month, commencing on 11-1-2010, and each month thereafter, until this section is modified or repealed. The moneys accumulated in the EMS Fund shall be utilized only as provided in divisions (C) and (D) below.
   (C)   Expenditures. Except as provided in division (D) below, no moneys deposited into the EMS Fund shall be expended, except to purchase, upgrade or replace ambulance vehicles, cots, monitors, computer equipment and other equipment necessary for the operation of the EMS.
   (D)   Transfer. In the event the EMS establishes that the EMS Fund has accumulated moneys in excess of those needed for the purposes set forth in division (C) above, the EMS Director may, with the approval of the Board of Commissioners, transfer funds from the EMS Fund into the Ambulance Fund for uses related to the general operation of the EMS.
   (E)   Appropriations. Expenditures from the EMS Fund shall be subject to appropriation by the County Council.
   (F)   Effective date. This section shall be effective upon its passage.
