§ 93.99  PENALTY.
   (A)   Any person who smokes or uses electronic cigarettes in an area where smoking or using electronic cigarettes is prohibited commits prohibited smoking, a Class B infraction, unless such person has been adjudged to have committed three prior smoking related infractions, in which case prohibited smoking is a Class A infraction.
   (B)   A person who violates any provision of this chapter other than division (A), commits a Class A ordinance violation and may be fined the sum of $50 per violation.
   (C)   A person who is found to have violated any provision of this chapter other than division (A), a second time within one year of a previous violation may be fined up to the sum of $100.
