§ 92.11  EFFECT OF HIGHWAY RECORDS AND PRIOR COUNTY MAINTENANCE.
   The Highway Department records shall be presumptive evidence in any and all courts as to the existence of the road as a county highway. The fact that there are certain old maps in which roadways are designated as being “state road” or “public roads” or “county roads” shall not be binding upon the county or create a duty upon the county to maintain the road. Likewise, the fact that the county may have, in the past, maintained any portion of any roadway shall not be construed to create a duty upon the county to continue the maintenance.
