§ 96.01 OPEN BURN.
   (A)   OPEN BURNING is defined as the burning of any materials wherein air contaminants resulting from combustion are emitted directly into the air, without passing through a stack or chimney from an enclosed chamber.
   (B)   No person shall start, kindle, cause, allow, or maintain any form of open burning of any materials on private or public property, except as specifically authorized by this chapter. No person shall allow the accumulation or existence of combustible material that constitutes or contributes to open burning.
   (C)   Burning of materials in the City of Greendale, Indiana is restricted under the following:
      (1)   Open burns are prohibited unless a permit is obtained from the Greendale Fire Department.
      (2)   Upon obtaining a permit, open burns shall be limited to the following specifications:
         (a)   Only limbs, prunings, natural growth, and other natural wood products are permitted to be burned.
         (b)   Open burning of vegetative matter grown on the premises in the course of agricultural
operations, when it can be shown that such open burning is necessary and that no fire hazard will occur, provided the person intending to dispose of vegetative matter by open burning obtains approval from the fire department, which has jurisdiction.
         (c)   The open burn can only be conducted during daylight hours and only during favorable weather conditions at the discretion of the fire department.
         (d)   The open burn must be at least 50 feet away from any structures or trees.
         (e)   The Greendale Fire Department can terminate any open burn at any time if the open burn is considered a nuisance.
         (f)   All open burns must be attended at all times with a reliable water source at hand or have other means of extinguishment on hand.
         (g)   Private residential burning, where the building contains four or fewer dwelling units shall be allowed. Burning is prohibited in apartment and condominium complexes and mobile home parks.
         (h)   The fire shall not be within 500 feet of a pipeline or fuel storage area.
         (i)   The pile to be burned shall be less than 1,000 cubic feet (for example: 10' length x 10' width x 10' height) and only one pile may be burned at a time.
      (3)   The burning of charcoal, clean untreated wood, and other cooking fuels customarily used in an outdoor grill, traditional food cooking devices, or campfires shall be allowed.
      (4)   Burning of any fuels, plastics, garbage, or other non-natural wood material is prohibited.
      (5)   Permits for open burns must be kept at hand with the attendee of the burn.
      (6)   The Fire Chief may issue permits for open burns that violate this chapter under special circumstances (i.e. ceremonies, school events, etc.).
