§ 152.06 LOCATION AND OCCUPANCY OF MODULAR HOMES.
   Location and occupancy of a modular home shall be considered a single-family or two-family residential use, and a modular home may be erected and occupied on any conforming lot in any primary zoning district wherein single-family or two-family dwellings are permitted or conditional uses or may be permitted under an approved residential unit development plan in accordance with the Zoning Ordinance. All provisions of the Zoning Ordinance applicable to traditionally constructed single- or two-family dwellings shall apply equally to modular homes, including provisions for improvement location permits and certificates of occupancy. A factory-constructed modular home shall be presumed to comply with applicable provisions of the Building Code if it bears a seal certifying that it was built in compliance with the Federal Manufactured Housing Construction and Safety Standards Act of 1974 (42 U.S.C. §§ 5401 et seq.) in accordance with I.C. 36-7-4-1106(1), and a building permit will not be required; otherwise, or if the structure is substantially modified, the permit is required as with all other single- or two-family dwellings. A modular home shall be erected upon and firmly secured to a foundation of a type suitable and permitted for other such dwellings, and a building permit shall be required for the excavation and construction of the foundation whether or not required for the principal structure as well.
