§ 30.35 CITY COUNCIL MEETINGS; NOTICES.
   (A)   The City Council shall have no definite session or sessions during the year, but shall be in continuous session for the conduct of the legislative business of the city government.
   (B)   The continuous session shall consist of the meetings as are required for city business as follows.
      (1)   Regular meetings. A regular meeting of the City Council shall convene at 7:00 p.m. on the second Wednesday of each month. At least 48 hours before the first regular meeting of each year, the Clerk-Treasurer shall:
         (a)   Post a schedule of the regular meetings outside the City Council’s regular meeting place; and
         (b)   Mail a copy of the schedule to any of the news media having requested that notice, in writing, prior to January 1 of the year.
      (2)   Special meetings.
         (a)   Special meetings of the City Council may be convened at any time or place for the conduct of any city business which, in the opinion of the person calling the special meeting, cannot reasonably await the next regular meeting. A special meeting may be called by the Mayor, or by the President Pro Tempore if the Mayor is absent from the city, or by a written petition signed by a majority of the Members of the City Council and delivered to the Clerk-Treasurer. When a special meeting is called, the Clerk-Treasurer shall immediately give notice thereof, by mail, telephone, or in person, to all Members of the City Council and the Mayor other than those calling the special meeting, and stating the time, place, and principal purpose of the meeting. However, a special meeting, once convened, need not be limited to the principal purpose for which it was called, and any other business proper to the City Council may be introduced and conducted at the special meeting. Except in an emergency threatening the public welfare or the integrity of operations of the city government, a special meeting shall be called at least 72 hours before the time fixed for the meeting. If notice is given in a timely manner, and in good faith, in accordance with this section, the fact that any official fails to receive the notice prior to a special meeting shall not be construed to compromise any action taken at the meeting in the absence of such, nor shall the action be compromised if any official failing to receive notice attends the meeting anyway or signs a waiver of notice either before or after the special meeting.
         (b)   In addition, if possible, the Clerk-Treasurer shall post notice of the special meeting outside the meeting room and shall notify requesting news media at least 48 hours in advance, or as soon in advance as possible, but pursuant to I.C. 5-14-1.5-5 the notice is not otherwise required, and failure of the Clerk-Treasurer to give the notice does not compromise any action taken at the special meeting.
