§ 112.15 DEFINITIONS.
   For the purpose of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   COMMODITY. Any real or personal property, merchandise, produce, intangible asset or security (including any insurance policy), subscription, membership, ticket, or work or service to be performed by contract or agreement other than as an employee or agent of the person for whom the work or service is performed, irrespective of whether any of the aforementioned are offered for immediate or future delivery.
   ITINERANT MERCHANT. Any person who sells or offers for sale any commodity and who:
      (1)   Conducts the business by standing or moving about on streets, sidewalks, or other public places, or by operating from a portable stand, pushcart, or vehicle not constituting a fixed and established place of business; or
      (2)   Operates as a transient merchant, conducting the business from a room, building, structure, or lot rented or leased for the purpose of carrying on the business, and with intent to do so for less than a continuous period of 120 days.
   PEDDLER. Any person who sells or offers for sale any commodity by traveling door-to-door between dwelling places or business establishments; or by telephone solicitation, calling from one telephone to another, both of which are located within the corporate limits of the city, when there exists an offer or intent by the caller to complete or agree to complete the sale of a commodity by means of the telephone call; and without prior consent or arrangement by the occupant of the premises or his or her presumptive agent.
