(A) This section shall apply to requests for water, electric, and/or sewer service to be provided by the city to any proposed real estate development where any portion of the boundary of the proposed development lies within one-fourth mile of the corporate limits of the city.
(B) Before the city will agree to provide water, electric, or sewer service to any proposed development where the request is subject to this section, the City Council must have first determined that the proposed plan of development will not have an adverse impact on property, property uses, and property owners within the corporate limits of the city and that the proposed development is consistent with and not in conflict with the city’s Zoning Ordinance and/or comprehensive plan applicable to the areas in the vicinity of the proposed development that are within the corporate limits of the city.
