(A) Except as provided in division (B) of this section, no person shall maliciously or willfully, and without the consent of the owner, kill or injure any dog, cat or other animal that is the property of another. This section does not apply to a licensed veterinarian, animal warden or law enforcement officer while acting in an official capacity.
(B) An unsecured dog that is chasing, menacing or injuring any person or domestic farm animal which is the property of another, can be killed at that time, except when necessary to comply with the requirements of a rabies quarantine period.
(C) Whoever violates this section is guilty of a misdemeanor of the second degree if the value of the animal killed or the injury caused amounts to less than $300. If the value of the animal killed or the injury caused amounts to $300 or more, such person is guilty of a misdemeanor of the first degree.
