§ 76.23 COMPRESSION RELEASE BRAKES PROHIBITED.
   (A)   Definition. For the purpose of this section, COMPRESSION RELEASE-TYPE BRAKING SYSTEM shall mean any device equipped on certain commercial vehicles, including, but not limited to, tractors, semitrucks, motor carriers and buses that utilize engine compression release or engine retarders as a means of slowing or braking the speed of the vehicle in lieu of applying the clutch or brakes. A COMPRESSION RELEASE-TYPE BRAKING SYSTEM is also referred to as “jake brakes,” “jacob’s brake,” “engine brake” or “dynamic braking device.”
   (B)   Use prohibited. It shall be unlawful for any person to operate any motor vehicle with a compression release-type braking system to cause their vehicle to brake or slow by any method which increases the noise emission levels of the engine, such as, but not limited to, engine compression release brakes or engine retarder in lieu of applying the clutch or brakes upon any public street, road or highway within the limits of the city. This section shall not apply to fire protection equipment or other emergency vehicles, or if used by an operator of a vehicle in an emergency situation to avert imminent danger.
   (C)   Penalty. Violation of this section shall be a minor misdemeanor punishable by a fine of not more than $100 for each offense.
