§ 35.07 SINGLE AGGREGATE BIDS.
   (A)   (1)   Pursuant to § 3, Article XVIII of the Ohio Constitution and the City Charter, City Council hereby authorizes the Mayor to advertise for and award single aggregate bids for the erection, repair, alteration or rebuilding of a public building when the estimate for the improvement is under $500,000. Nothing in this provision shall be deemed to eliminate the discretion of the Mayor to advertise for and award separate bids for components of any improvement that is under $500,000.
      (2)   When the estimate for the improvement is $500,000 or more, the Mayor shall advertise for a single aggregate bid and separate bids for the components set forth in R.C. § 153.50(B)(1) through (3) and then award the bid to the lowest and best bidder or bidders.
   (B)   City Council hereby specifically finds and determines that R.C. §§ 153.50 to 153.52 shall not be applicable to the city, insofar as they conflict with the terms of this section.
   (C)   Nothing in this section shall be construed to prohibit the city from advertising for and awarding separate bids for each separate trade or kind of mechanical labor, employment or business, or for furnishing materials for the erection, repair, alteration or rebuilding of a public building if the combination of the necessary separate bids constitute the lowest and best bids as determined by City Council.
