(A) City-owned projects or structures deemed historic under any federal, state or local law are exempt from, but encouraged to comply with, the requirements of this legislation whenever feasible.
(B) If, due to specific economic circumstances, compliance with this legislation would defeat the intent or create an unreasonable burden on the city or project, a request for exemption shall be submitted in writing to City Council along with the request for appropriation for the project. The exemption request must explain the hardship or infeasibility, including detail of the burden and a life-cycle cost analysis.
(1) If individual project appropriation will not be necessary, the Green Building Compliance Official will submit the request for exemption to the Mayor, who will then make the final determination.
(2) If a waiver is granted by City Council, the project design will reflect as many LEED credits as reasonably achievable.
