§ 150.35 PERMITS AND BONDS.
   (A)   Permits.
      (1)   A drainage permit must be obtained in the name of the property owner or contractor prior to closure of a roadside drainage ditch within the jurisdiction of the city, through the Department of Public Service.
      (2)   The nonrefundable permit fee shall be $40. Acceptable forms of payment shall be a check or money order made payable to the city. The permit shall be valid for 60 days from the date of issue.
   (B)   Performance bonds.
      (1)   A performance bond must be posted prior to issuance of a road opening or drainage permit.
      (2)   The bond amount shall be determined by the Director of Public Service or his or her designee. The minimum bond amount shall be $500.
      (3)   Acceptable bond forms shall include cashier’s check or money order made payable to the city.
      (4)   The bond will be held pending final inspection or approval of the ditch enclosure by the Department of Public Service or City Engineer’s office.
