§ 150.33 RESPONSIBILITY OF PROPERTY OWNERS.
   (A)   If the city determines that the driveway pipe is in substandard or poor condition or at an elevation that does not coincide with the proposed ditch enclosure pipe, the property owner shall replace the driveway culvert with new pipe to match the type of pipe used for the ditch enclosure.
   (B)   The property owner shall obtain and pay for the necessary permit(s) and bond(s) required by the city.
   (C)   Any property owner who has enclosed a roadway ditch disregarding any or all of the requirements contained in this subchapter shall remove or correct the enclosure pipe and appurtenances as determined by the city. Failure to comply shall constitute cause for removal of the enclosure by the city, at the property owner’s expense, in addition to the penalty set forth in § 150.99.
