§ 32.09 SICK LEAVE, PERSONAL LEAVE, FUNERAL LEAVE, VACATION LEAVE AND COMPENSATORY TIME FOR REGULAR, FULL-TIME NONBARGAINING EMPLOYEES; AUTHORITY OF FINANCE DIRECTOR.
   (A)   All regular, full-time employees are entitled to sick leave benefits accumulated, without limitation, at a rate of ten and one-half hours for each completed calendar month worked.
   (B)   An employee who transfers from another political subdivision or public agency to a position with the city may transfer any unused balance of sick leave from his or her previous position to the city, pursuant to the applicable sections of the Ohio Revised Code. It is the employee’s responsibility to furnish a written statement from the previous employer certifying the termination date and the total transferrable accumulated sick leave balance upon termination.
   (C)   (1)   Any employee who, by reason of age and service, is granted retirement or disability under the Police and Firemen’s Disability and Pension Fund, is entitled to a payment in cash for 50% of all accumulated and unused sick leave. The procedure and calculation of the payment will be based upon the following:
         (a)   The employee must request, in writing, addressed to the appointing authority, payment for accrued unused sick leave.
         (b)   Upon receipt of documentation that the retirement or disability request has been authorized by the Police and Firemen’s Disability and Pension Fund, the payment will be based upon the employee’s rate of pay at retirement or disability.
         (c)   Such payment may not exceed 960 hours.
      (2)   In the event of the death of any employee, the employee’s heirs shall be entitled to receive the same benefit as if the employee retired.
   (D)   Any eligible employee who has used 24 hours or less of accrued sick leave during an entire calendar year, will earn eight hours of personal leave. The personal leave must be used during the calendar year immediately following the year it was earned, may not be carried over and may not be sold back to the city as leave. An eligible employee is a regular, full-time employee who has completed one full calendar year of employment with the city.
   (E)   All regular, full-time employees are entitled to paid funeral leave due to the death of an immediate family member. Immediate family member, as used in this section, includes the parents, spouse, children, siblings, grandparents and grandchildren of the employee and of his or her spouse. An eligible employee is entitled to seven consecutive days off due to the death of a spouse or child, and three consecutive days off due to the death of a parent, sibling, grandparent or grandchild of the employee or of his or her spouse.
   (F)   Unused vacation leave and compensatory time accrued by employees may be sold back to the city by completing the appropriate paperwork and submitting it to the Finance Department by November 1. An employee will receive compensation at his or her current hourly rate, by separate check, in December. A maximum of 48 hours of compensatory time and 40 hours of vacation leave may be carried into the next calendar year.
   (G)   The Finance Director is hereby authorized and directed to administer sick leave, funeral leave, sick leave incentive and leave sale compensation benefits to regular, full-time, nonbargaining employees of the city, in conformity with this section.
   (H)   Upon separation from employment due to death or retirement, full-time employees (or their estate, if upon death), shall be compensated, at their regular base hourly rate at the time of retirement or death, for 50% of all accumulated and unused sick leave, up to a maximum of 960 hours.
