§ 72.309   CONTRACTUAL INDEMNIFICATION; SUBROGATION
   (A)   No conveyance, transfer, sale, indemnification, hold harmless, or similar agreement shall be effective to release the owner or operator of any facility or vessel or any person who may be liable for a release of hazardous materials or threat thereof under this article. Nothing in this section shall bar any arrangement to insure, hold harmless, or indemnify a party to such agreement for any liability under this article.
   (B)   Nothing in this section, including the provisions of subsection (A), shall bar a cause of action that an owner or operator or any other person subject to liability under this article, or a guarantor, has or would have, by reason of subrogation or otherwise against any person.
