If no petition for appeal is filed with the Board of Zoning Adjustments and Appeals within ten (10) days from the date of service of the Condemnation Notice on the owner of the offending structure, the owner of the real property upon which the structure that is the subject of the Condemnation Notice is located, the right of appeal and to a hearing before the Board of Zoning Adjustments and Appeals shall be deemed waived and the City of Grayson may proceed to act in accordance with the Condemnation Notice and as otherwise permitted in this article and applicable law.
