(A) In the event the City Code Enforcement Officer and/or City Fire Chief issues a Condemnation Notice, as provided herein, the Condemnation Notice shall be placed on the structure that is the subject of the Condemnation Notice. A duplicate copy of the Condemnation Notice shall be sent, via certified mail, to each owner of the structure and each owner of the property in which the structure that is the subject of the Condemnation Notice is located. Each duplicate copy of the Condemnation Notice shall be mailed, as provided herein, to the last-known address of each owner of the structure and each owner of the property in winch the structure that is the subject of the Condemnation Notice is located as reflected in the records of the County Property Valuation Assessor's Office.
(B) Every Condemnation Notice issued in connection with this article shall:
(1) Be in writing;
(2) Be conspicuously identified as "Condemnation Notice" which shall appear at or near the top of the first page of the Condemnation Notice;
(3) Contain the mailing address and telephone number of the City of Grayson;
(4) Identify by full name and state the mailing address of the City Code Enforcement Officer and/or City Fire Chief that issued the Condemnation Notice;
(5) Contain the name and address of each owner of the structure which is the subject of the Condemnation Notice;
(6) Contain the name and address of each owner of the property upon which the structure that is the subject of the Condemnation Notice is located;
(7) Contain the physical address of the premises upon which the structure that is the subject of the Condemnation Notice is located as reflected in the local records of 991 Dispatch Services. If the structure that is the subject of the Condemnation Notice has no local 991 Dispatch Service assigned address, and if the physical address of the property upon which the structure is located has no publicly identifiable or ascertainable address, the Condemnation Notice shall describe the location of the structure with such particularity as will reasonably describe its location;
(8) Set out the date the structure was inspected;
(9) Set out the date the Condemnation Notice was placed on the structure and sent, via certified mail, as provided herein;
(10) Contain a statement of all material facts, deficiencies, problems, conditions, and reason(s) for the Condemnation Notice, and, if applicable, a description of each repair, improvement, or other action required to be taken to bring the structure into compliance with this article;
(11) If applicable, include a statement that within the time stated in the Condemnation Notice, but in no event less than twenty (20) days from the date of the Condemnation Notice or longer than ninety (90) days there from, each deficiency, problem, condition and/or identified reason(s) for the Condemnation Notice shall be abated, repaired, corrected or remedied;
(12) If applicable, include a statement that if the deficiencies, problems, conditions and/or reason(s) for the Condemnation Notice are not abated, repaired, corrected or remedied by the owner or if the offending structure is not demolished and/or removed by the owner within the time stated in the Condemnation Notice, but in no event less than twenty (20) days from the date of the Condemnation Notice or longer than ninety (90) days therefrom, the City of Grayson may abate, repair, correct or remedy the deScien(cies), problem(s), condition(s) and/or reason(s) for the Condemnation Notice or demolish and/or remove the structure from the premises, and the City of Grayson will charge owner of the structure and/or owner of the property upon which the structure that is the subject of the Condemnation Notice is located, all associated costs and expenses incurred to abate, repair, correct or remedy the deficiencies, problems, conditions and/or reason(s) for the Condemnation Notice or to demolish and/or remove the structure from the premises, including related clean-up costs or expenses;
(13) If applicable, include a statement that any and all costs or expenses associated with the demolition and/or removal of an offending structure, including related clean-up costs or expenses shall impose a lien against the subject real property;
(14) If applicable, include a statement that any and all costs or expenses incurred to correct, repair and/or remedy the deficiencies, problems, conditions and/or reason(s) for the Condemnation Notice, including related clean-up costs or expenses, shall impose a lien against the subject real property;
(15) If applicable, include a statement that the owner of the structure and/or owner of the property upon which the structure that is the subject of the Condemnation Notice is located are personally liable for the amount of any lien, including all interest, civil penalties, and other charges, and the City of Grayson may bring a civil action against each owner to enforce the lien and to recover all costs and expenses incurred;
(16) Include a statement that any owner of the structure, any owner of the premises in which the structure that is the subject of the Condemnation Notice is located, or other aggrieved person or entity, have the right to appeal to and request a hearing before the Board of Zoning and Adjustments and Appeals to contest the Condemnation Notice and/or any aspect of the adoption, enactment or enforcement of this article by filing a petition for appeal before the Board of Zoning Adjustments and Appeals at the Grayson City Hall, 302 East Main Street, Grayson, Kentucky 41143; and
(17) Include a statement that a determination of the City Code Enforcement Officer and/or City Fire Chief as set out in the Condemnation Notice is and shall be final unless a petition for appeal is filed as provided herein.
