(A) “Nonquota type 2" or “NQ2" retail drink license may be issued to a qualifying establishment. NQ2 retail drink license may be issued to a hotel with at least fifty (50) sleeping units and dining facilities for at least one hundred (100) persons which receives from its total food and beverage sales at least fifty percent (50%) of its gross receipts from the sale of food. NQ2 retail drink license may be issued to a restaurant with a minimum seating for fifty (50) consumers at tables.
(B) A qualifying hotel or a restaurant with seating for at least one hundred (100) consumers at tables that holds an NQ2 retail drink license may purchase, receive, possess, and sell distilled spirits, wine, and malt beverages at retail by the drink for consumption on the licensed premises.
(C) The NQ2 retail drink licensee shall purchase distilled spirits, wine, and malt beverages only from licensed wholesalers or distributors.
(D) The NQ2 retail drink license does not authorize the licensee to sell distilled spirits, wine, or malt beverages by the package.
(E) A restaurant holding an NQ2 retail drink license which has seating for more than fifty (50) but less than one hundred (100) consumers at tables may only purchase, receive, possess, and sell wine and malt beverages at retail by the drink for consumption on the licensed premises. The licensee under this subsection shall purchase wine and malt beverages only from licensed wholesalers or distributors. The NQ2 license does not authorize the licensee to sell wine or malt beverages by the package.
