(A) The penalty for violation of this chapter is as follows:
(1) First offense. For the first offense a fine of fifty dollars ($50.00);
(2) Second offense. For the second offense within twelve (12) months, a fine of one hundred dollars (S100.00);
(3) Third and subsequent offenses. For the third and subsequent offenses within twelve (12) months, a fine of two hundred dollars ($200.00).
(B) Payment of fines and fees. Within seven (7) days from the date of the issuance of the citation for a violation of this chapter, any person cited pursuant to this chapter shall:
(1) Pay to the city the civil penalty prescribed in the citation by tendering payment to the City of Grayson - City Hall, 302 East Main Street, Grayson, Kentucky 41143; or
(2) Request a hearing, in writing, regarding such citation and/or penalty before the Board of Zoning Adjustments and Appeals located at City of Grayson - City Hall, 302 East Main Street, Grayson, Kentucky 41143.
(3) Failure to pay the citation or to request a hearing within the required seven (7) days shall result in Board of Zoning Adjustments and Appeals' entry of a final order determining:
(a) The person cited to have waived his or her right to a hearing;
(b) The citation and fine to be proper under this chapter; and
(c) The assessment of an administrative fee in an amount equal to the original citation fine.
(C) All fines and fees shall be payable to the City at the City of Grayson - City Hall, 302 East Main Street, Grayson, Kentucky 41143.
(D) Within seven (7) days after entry of a final order by Board of Zoning Adjustments and Appeals, the City of Grayson may, at its discretion, file a civil action in the Carter District Court against the responsible party or parties to enforce the citation, final order of the Board of Zoning Adjustments and Appeals, collection of fines, fees and/or penalties for violation of this chapter.
