§ 30.227   CONDITIONS
   No raw sewage shall be accepted by the plant unless the following conditions are met:
   (A)   All raw sewage shall be hauled only by licensed raw sewage transporters.
   (B)   Prior to transporting raw sewage to the plant, license raw sewage transporters shall apply to the Superintendent of the Utilities Commission for approval. The Superintendent and the head operator of the plant, in their sole discretion, shall approve or disapprove each application in writing, based upon a review of the applicant's license, bond, equipment, and other material, relevant criteria that they may from time to time establish.
   (C)   Licensed raw sewage transporters shall supply to the plant operator a waste tracking document each time when dumping waste. This document shall contain the time, date and location of all waste collected and being disposed of, a description of whether the waste is from a septic system, package plant, or other source described in particularity, and other information that the plant operator may reasonably request. The document shall remain on file with the plant, and shall beheld for city use and purposes only, and not for public disclosure except as is required or permitted by law.
   (D)   If the plant operator reasonably suspects or otherwise determines that there may be substances other than raw sewage present, or substances that would be unreasonably difficult to treat, or if any other good reason appears to exist to the operator, the operator may refuse to accept the delivery, or terminate the dumping if the same is in progress.
   (E)   Raw sewage shall be delivered only between the hours of 8:00 a.m. and 3:00 p.m., and then only if the operator is on duty at the plant.
   (F)   The plant may limit the maximum number of approved licensed raw sewage transporters, and the maximum amount of raw sewage that may from time to time be accepted. Among other reasons, hauls may be rejected if in the opinion of the operator or the Superintendent plant capacity or other exigent circumstances exist.
   (G)   All approved licensed raw sewage transporters, as a condition to their approval and use of the sewage treatment plant system, shall agree in writing to hold the city, its officers and employees, harmless from all liability that may in any way arise or result from the licensed raw sewage transporter's use of the plant, or from any termination of the privilege to use it, or from any refusal of its use. The approved licensed raw sewage transporter shall agree to waive all right to claims for damage or injury that may arise as a direct or indirect result of the approval to use the system, any refusal to permit dumping, or any suspension or termination of the privilege to use the plant.
   (H)   This authorization for the sewage treatment plant to accept raw sewage from licensed raw sewage transporters may be suspended temporarily, permanently, or may be withdrawn by valid action of the legislative body of the city, without prior notice.
