(A) Definitions.
(1) City fire apparatus and equipment shall include any vehicle, apparatus or other equipment owned, leased, borrowed, insured against loss or damage, or otherwise in the custody and control of or by the city for use by the Fire Department.
(2) The current publication of Standard 1901 of the National Fire Protection Association shall be referred to in order to define types of firefighting equipment and/or apparatus defined for purposes of this section and said publication is adopted as an official reference for purposes of this section.
(3) A first responder shall be defined as any firefighter, EMT, or other emergency responder engaged in his or her official performance of duties as a responder in assistance to the public.
(B) Fire Department.
(1) The primary response area of the Fire Department shall be within the corporate limits of the city.
(2) All vehicles, equipment and personnel of the Fire Department shall be available and used under the direction of the Fire Chief and at the discretion of the Fire Chief for any emergency or to benefit the public within the city limits of the city.
(3) The use of any fire apparatus equipment or personnel of the Fire Department outside the city limits of the city will be utilized only in accordance with written guidelines adopted by the Fire Chief and approved by the City Council done within sixty (60) days following enactment of this section which, upon adoption by the City Council, will become a part of this section.
(4) The City Council alter or suspend use of any fire apparatus equipment or personnel outside the city limits of the City if done so at a duly called regular or special meeting of said Council and shall do so upon all reasonable facts available to it including any financial burden imposed upon the city as a result of same or inadequate equipment available to residents and other personnel within the city limits.
(5) In addition to the foregoing, the use of city fire apparatus equipment and personnel outside the city limits of the city is authorized when done in response to a request for assistance by another agency, as well as when assisting the Police Department when requested to do so in the proper course and scope of the Police Department duties. Provided, however, that at no time shall there be more than one (1) city pumper responding outside the city limits.
(6) The city may also employ fire apparatus equipment and personnel outside the city limits of the city in connection with a mutual aide agreement.
(7) Should there be a breakdown of equipment and apparatus due to repairs or other damage or destruction, then the Fire Chief shall notify the Mayor of said fact. The Mayor at that point shall have the authority to declare an emergency suspending all fire protection outside the city limits until the breakdown or other damage emergency is resolved.
