§ 31.41 SAFETY DIRECTOR.
   (A)   (1)   The position of Safety Director shall be appointed by the Mayor and serve in an at-will capacity at the pleasure of the Mayor. The Safety Director’s term shall be for the length of the term of the office of the Mayor who appoints a Safety Director, if not terminated sooner by the Mayor at his or her pleasure. In no event shall the term of the Safety Director extend past the term of office of the Mayor, who has appointed the Safety Director. The Safety Director may be paid in an amount to be determined by the City Council.
      (2)   The Safety Director shall also inform the Mayor of all relevant information on more than a monthly basis in support of the Mayor’s executive function. The appointed Safety Director shall have no authority to bind the city and have only such executive authority granted to him by the Mayor. The Safety Director’s primary function is to gather information and report on same concerning the Police Department, to better inform the Council and Mayor on the activities of the Police Department.
      (3)   The appointed Safety Director shall undertake each month to talk with the Chief concerning the activities of the Police Department, its receipt and expenditures (including a monthly printout of all purchases provided by the Chief), its management and employees and report on these matters to the
Council and Mayor at the regular monthly meeting. The appointed Safety Director shall have a key to the police office and access to its files to perform his or her information gathering, except for protected information or materials.
      (4)   The appointed Safety Director shall also personally talk with any officer concerning any matter which may impact detrimentally on the Police Department or the city. The appointed Safety Director shall also physically visit, at least one time each month, the offices of the Police Department. In addition, the appointed Safety Director shall be allowed to ride with the officers on patrol with 24-hour notice to the Chief, subject to any emergency for which the Chief may direct otherwise.
   (B)   (1)   Each month the Safety Director may make a written report to the Council and Mayor at the regular Council meeting concerning the activities of the Police Department. This report shall include information concerning all citations and warnings issued and runs made by the Police Department in the last month, excluding protected information.
      (2)   (a)   The Safety Director may also inform the Council and Mayor of any significant issues in the past month concerning the actions of any member of the police force which may be the basis of a:
         1.   Disciplinary charge against a member of the Police Department;
            2.   Complaint by the public against the Police Department, or a member of the Police Department; and/or
            3.   Complaint by a city employee against the Police Department, or any member of the Police Department.
         (b)   If there is any matter which by its nature involves personnel or pending litigation, the Safety Director shall report this matters in a properly called executive session of the Council.
      (3)   The Safety Director shall also report to the Council and Mayor on any other matter including, but not limited to, the police budget, facilities, or management, which the Safety Director deems important for the Council and Mayor to know in order for them to perform their oversight function, including all matter which the Mayor of the City Council acting through their Mayor may wish to have included.
      (4)   In addition to the above described monthly reporting, the Safety Director shall immediately report any matter listed above deemed by the Chief to be of immediate importance to the Mayor of the city.
   (C)   It shall also be the responsibility of the Chief and the appointed Safety Director to make a yearly inventory of guns, radios, autos, computers, faxes, scanners and any other equipment of significant value (in the opinion of the Chief) and list for each an identifying number such as a serial number or VIN number. The yearly inventory must also list the whereabouts of each item.
