No such burning is permitted outside of buildings or structures in the village unless in accordance with all of the following conditions.
(A) Location. No burning shall be allowed within 20 feet of an existing building or five feet of a property line, provided that no adjacent building is within 15 feet of said property line.
(B) Container. Burning in any container commonly referred to as a burn barrel, or similar container, is prohibited at all times. Approved open cooking fires or bonfires must be contained in a barbecue grill or fire pit consisting of a metal ring or stone, brick or concrete structure.
(C) Time. No such burning shall be done prior to sunrise and must not be continued after sunset in any one day.
(D) Size. No such burning shall be done in an area exceeding 15 square feet (three-foot circular).
(E) Nuisance. No burning shall be done at any time or place of garbage, refuse, construction waste or any materials which, when burning, give off foul, noxious or obnoxious odors or a dense smoke, or when wind conditions will create or be apt to create a nuisance to anyone, or to the property of anyone, in the vicinity thereof.
(F) Fires. The Village Council or its designated agent may prohibit such fires when atmospheric conditions or local circumstances are deemed, in its sole discretion, to make such fires hazardous in its discretion.
(G) Permit. When open burning is allowed in the village, as designated by Village Council, a permit shall first be obtained from the Grass Lake Charter Township Fire Chief or designee.
(H) Construction materials. During construction or demolition of buildings or structures, no waste material or rubbish shall be disposed of by burning on the premises or in the immediate vicinity within the village.
(I) Open burning. No person shall kindle or maintain any bonfire or brush fire or authorize any such fire to be kindled or maintained, except on days so authorized by Village Council (generally the last Saturday of the months of January, February and March), without having obtained a permit from the Grass Lake Charter Township Fire Chief or designee. Permits may be rescinded by the Fire Chief and open burning shall be prohibited, including all bonfires and open cooking fires, when atmospheric conditions or local circumstances make such fires hazardous.
