171.04 POWERS AND DUTIES OF THE MUNICIPAL COURT CLERK.
   (a)   The Municipal Court Clerk, under the supervision and direction of the Court Administrator of the Municipal Court, shall have the custody and care of the books, papers and records of the Municipal Court. The Municipal Court Clerk or Deputy shall be present during the session of such Court. The Municipal Court Clerk shall receive all fines, penalties and fees of every kind, and keep a full, accurate and detailed account of the same; and shall each week pay into the City Treasury all moneys received for the Town during the day pervious, with a detailed account of the same and taking the Treasurer’s receipt therefor.
   (b)   The Mayor shall be furnished a monthly record of Court activity. Record retention shall be in accordance with State law.

   (c)   In the absence of or in the case of the inability of the Municipal Court Judge to perform his or her duties, the Municipal Court Clerk, or other official designated by Town Council, may act as Municipal Court Judge provided, that the Municipal Court Clerk or other designated official, shall comply with the requirements of West Virginia Code Section 8-10-2(b) and (c).
