(a) Each day that a violation of this section continues shall be considered a separate and distinct ofense.
(1) No person shall be found in violation of Section 550.01(b)(2) unless the Town proves by a preponderance of the evidence that the abatement measures were reasonable and warranted, and that the defendant knowingly failed to implement them.
(2) A person may be found in violation of subsection (b)(1) or (b)(2) of Section 550.01 regardless of whether an order of abatement is issued under Section 550.02 or in violation of Section 550.01(b)(1) regardless of whether a notice has been given under Section 550.02. A fine in accordance with subsection (c) may be assessed by the Town of Granville Municipal Court.
(b) Upon a finding of liability under this article, the defendant shall be fined: not less than one hundred dollars ($100.00) and not more than one thousand dollars ($1,000.00) per offense. (Passed 2-25-20.)
