(a) Monongalia County Urban Mass Transit Authority, d/b/a Mountain Line is hereby authorized to develop a park and ride parking lot on the real estate depicted in Exhibit A to this section. Such development shall include a parking lot, control arm, and two (2) shelters. Additional development shall be permitted only with the consent of the Town Council of the Town of Granville which consent will not be unreasonably withheld.
(b) Monongalia County Urban Mass Transit Authority, d/b/a Mountain Line, shall be permitted to pick up and drop off passengers at the aforesaid parking lot on such schedule as may be determined by Monongalia County Urban Mass Transit Authority, d/b/a Mountain Line.
(c) Monongalia County Urban Mass Transit Authority, d/b/a Mountain Line, may discontinue the operation of the aforesaid park and ride parking lot upon thirty (30) days written notice of the Town of Granville.
(d) The Town of Granville may revoke the authority granted herein by giving to Monongalia County Urban Mass Transit Authority, d/b/a Mountain Line, written notice at any time. However, in the event the Town of Granville gives notice to Monongalia County Urban Mass Transit Authority, d/b/a Mountain Line, revoking the authority granted in this section, Monongalia County Urban Mass Transit Authority, d/b/a Mountain Line, shall be permitted to continue the operation of the park and ride parking lot for a sufficient period of time to allow it to comply with its legal obligations regarding the discontinuance of transit services.
(e) Upon termination of the authority granted by this section, Monongalia County Urban Mass Transit Authority, d/b/a Mountain Line, shall be permitted to remove all of its personal property from the park and ride parking lot so long as it does not damage the leased real estate.
(f) Monongalia County Urban Mass Transit Authority, d/b/a Mountain Line, shall maintain during all times that it operates a park and ride parking lot on the Town of Granville’s property, liability insurance in an amount not less than $5,000,000.00 and further, the Town of Granville shall be named as an additional insured under such insurance policy.
